James Divecha

Call 2021 | Barrister

About

Before coming to the Bar, James worked at a financial services firm where he acquired strong analytical and numerical skills through examining clients’ multiple financial arrangements. James has also worked at several law firms where he gained experience in family finance matters, employment law and commercial law. Throughout these experiences, James fostered excellent client management skills by listening to client concerns and establishing trust.

When not despairing over the current state of Chelsea Football Club, James enjoys playing cricket and squash. His love for travel allows him to explore different countries and immerse himself in other cultures.

During his pupillage with Chambers, James engaged in a variety of practice areas, with a strong focus on civil law, property law and family law. James accepts instructions in the following areas:

Civil Law

James has considerable experience in civil litigation disputes, having appeared in fast track and multi-track cases as well as small claim trials. He is regularly instructed to make interlocutory applications and attend CMCs. James has also represented clients in Consumer Credit Act proceedings.

James has a substantial paper practice. When drafting legal advice, particulars and skeleton arguments, James always demonstrates a strong attention to detail and an aptitude for making persuasive legal arguments.

Prior to commencing pupillage, James managed his own case load as a county court advocate. This enabled him to gain a robust understanding of civil procedure, along with developing his advocacy and organisational skills.

Property Law

James has a particular interest in chancery, property and trusts related work. During his pupillage, James assisted in preparing cases concerned with claims related to the Trusts of Land and Appointment of Trustees Act 1996. He has drafted pleadings on behalf of claimants in cohabitation disputes, and also has experience of drafting skeleton arguments and advice in relation to cases concerning proprietary estoppel and undue influence claims. His interest in this field was reinforced when he evaluated the law regulating unmarried cohabitees during his LLM dissertation, for which he achieved a distinction. This also led to him assisting with editing a chapter in a practitioner text focussed on property disputes between unmarried cohabitees.

James has appeared in a variety of possession hearings and he has represented both landlords and tenants. He has also recently expanded his practice to include mortgage disputes and commercial property litigation work.

Family Law

James has undertaken work across the family law spectrum with a particular emphasis on public children work. When representing parents at interim, fact-finding and final hearings in both public and private children cases, he has complemented his strong advocacy skills with empathy and clear-mindedness.

Having appeared at First Directions Appointments, Financial Dispute Resolution hearings and Final hearings, James is building up his practice in relation to family financial remedy disputes.

Employment Law

James has experience of appearing before the Employment Tribunal in preliminary and final hearings, involving claims for wrongful and unfair dismissal, discrimination and unpaid wages. He also accepts instructions from both employers and employees to undertake written work.
